تعریف فرزند وابسته برطبق حقوق مهاجرت کانادا

 در وبسایت اداره مهاجرت کانادا تعریف زیر برای فرزند وابسته ارایه شده است:

Definition of a dependent child as of October 24, 2017

Children qualify as dependants if they meet both of these requirements:

• they’re under 22 years old, and
• they don’t have a spouse or common-law partner.

Children 22 years old or older (also known as an overage dependent children) qualify as dependants if they meet both of these requirements:

• they have depended on their parents for financial support since before the age of 22, and
• they are unable to financially support themselves because of a mental or physical condition.

Definition of a dependent child from August 1, 2014, to October 23, 2017

Children qualify as dependants if they are:

• under 19 years old, and do not have a spouse or common-law partner, or
• 19 years old or older (also known as overage dependent children) and have depended on the parent’s financial support since before the age of 19 because of a physical or mental condition

بنابراین دو حالت مجزا را برای تعریف فرزند وابسته باید درنظر گرفت:

الف. در حالت عادی، اگر سن فرزند شخص متقاضی زیر 22 سال و مجرد (غیر متاهل) باشد بعنوان فرزند وابسته درنظر گرفته خواهد شد.

ب. در صورتی که فرزند شخص متقاضی 22 سال یا بیشتر داشته باشد در صورتی بعنوان فرزند وابسته درنظر گرفته خواهد شد که از نظر مالی قبل از سن 22 سال به والدین اش وابسته باشد و بدلیل شرایط ویژه ذهنی یا بدنی قادر به تامین هزینه های خودش نباشد.
