تحصیلکردگان حقوق در ایران و کار در کانادا بعنوان وکیل

 افرادی که در ایران در رشته حقوق تحصیل کرده اند و گاهی به وکالت نیز اشتغال داشته اند این سوال را مطرح می کنند که برای کار کردن در کانادا بعنوان وکیل چه مسیری را باید طی کنند. قبل از پاسخ دادن به این سوال باید به این نکته اشاره کرد که کانون وکلای استان های مختلف کانادا به طور مستقل عمل می کنند و بنابراین اولین گام در این مسیر این است که استان محل فعالیت آتی خودتان را انتخاب کنید و بعد از آن روندی را که توسط کانون وکلای آن استان مشخص شده است پیگیری کنید.

برای نمونه روندی که در استان «نوا اسکوشیا» باید پیگیری شود به شرح زیر است:

The following is an overview of the steps required to be called to the Bar in Nova Scotia:

1. Apply to the National Committee on Accreditation (NCA) to have the lawyer’s law degree and credentials assessed. Commence this process before immigrating to Canada as it will take time. 
   Note: Nova Scotia, as a province of Canada, is a Common Law jurisdiction. Therefore, the NCA criteria are generally greater for lawyers with civil law degrees and who practise in a country with a Civil Code than they are for lawyers with a non-Canadian common law degree.
2. NCA issues a Certificate of Qualification.
3. Submit an Application for Admission on Transfer to the Nova Scotia Barristers’ Society.
4. Application is considered by the Executive Director.
5. Application is approved.
6. Applicant completes the necessary requirements set by the Executive Director. This will include at the least the writing of the Bar Examination.
7. Upon successful completion of the conditions set by the Executive Director or the Credentials Committee (as per #5 above), the lawyer is eligible for admission to the Nova Scotia Barristers’ Society.

در استان ساسکاچوان باید اقدامات زیر را پیگیری کرد:

A lawyer seeking to be called to the bar in Saskatchewan who has obtained their legal credentials outside of Canada must:

• Obtain:

• a Canadian LL.B. degree or Juris Doctor; or
• a Certificate of Qualification issued by the National Committee on Accreditation (NCA)- This requirement applies to both students who hold law degrees from foreign law schools and foreign lawyers.

• Apply for admission as a student-at-law and complete the requirements for students-at-law, including the CPLED bar admissions program and articles.  Please refer to the Students section for further details of these requirements. 

A lawyer seeking to act as a Foreign Legal Consultant in Saskatchewan must complete and submit an Application for Permit to Act as Foreign Legal Consultant (Form A-16) pursuant to Law Society Rule 211.

در هر یک از مراحل فوق نیز باید مقررات خاص مربوط به آن مرحله را رعایت کرد تا در پایان این مسیر بتوان اجازه وکالت در آن استان (و نه کل کانادا) را بدست آورد. گروه استادکاران خدمات مشاوره ای خود در این مسیر را نیز در اختیار متقاضیان قرار می دهد.
