شرایط لازم برای گرفتن مجوز کار باز پوششی

 سوال: برای گرفتن مجوز کار باز پوششی آيا نيازى نيست پرونده اقامت دائم تا مرحله اى پيش رفته باشد و بعد از آن درخواست مجوز کار باز پوششی داده شود یا این که فقط درخواست اقامت دائم دادن كافى است تا فرد مجاز به اقدام براى مجوز كار باز پوششی باشد؟

پاسخ: شرایط لازم برای گرفتن مجوز کار باز پوششی در وبسایت اداره مهاجرت کانادا به این ترتیب توضیح داده شده است:

To be eligible for a BOWP, foreign nationals must

• be currently in Canada;
• have valid status on a work permit that is due to expire within the next 4 months;
• be the principal applicant on an APR under the FSWC, the CEC, the FSTC, the PNC (see note below), or 1 of the 2 caregiver classes;
• have completed 1 of the following APR stages:
• their electronic application for permanent residence (e-APR) submitted under Express Entry has passed the R10 completeness check; or
• they have received a positive eligibility assessment on their paper APR submitted by mail under 1 of the economic classes above;
• have applied for an open work permit;
• have paid the work permit processing fee and the open work permit holder fee; and
• have provided, as applicable, evidence (e.g., nomination certificate) that their provincial nomination is unrestricted.

منظور از دادن درخواست اقامت دایمی که یکی از شرایط اصلی گرفتن مجوز کار باز پوششی است به این نحو تعریف شده است:

• have completed 1 of the following APR stages:
• their electronic application for permanent residence (e-APR) submitted under Express Entry has passed the R10 completeness check; or
• they have received a positive eligibility assessment on their paper APR submitted by mail under 1 of the economic classes above;

در حالتی که درخواست برای شرکت در برنامه اکسپرس اینتری (اسکیلد ورکر) داده شده است باید این درخواست از مرحله «کنترل کامل بودن مدارک (آر.10)» عبور کرده باشد. منظور از مرحله مزبور در وبسایت اداره مهاجرت کانادا به این ترتیب توضیح داده شده است:

In Express Entry, applicants are required to submit a complete electronic application for permanent residence (e-APR) within 60 calendar days of being issued an invitation to apply (ITA). The application and all supporting documents must be submitted electronically through the applicant’s online account.

Applications are assessed for completeness up front. An application found to be incomplete should be rejected as per section 10 of the Immigration and Refugee Protection Regulations, and all fees associated with the application should be refunded to the applicant.

بنابراین در صورتی که مدارک ناقص باشد درخواست بلافاصله رد خواهد شد. اما در صورتی که مدارک ارسالی ظاهراً کامل باشند برای تایید کامل بودن مدارک باید مراحل زیر که در وبسایت اداره مهاجرت کانادا توضیح داده شده طی بشود:

Express Entry: determining if an e-APR has passed the completeness check

If a foreign national submits an APR using Express Entry, they may apply for a BOWP if they meet the eligibility requirements. However, a decision on the application will not be made until the Centralized Intake Office (CIO) has assessed the e-APR for completeness. A BOWP can be issued only if the e-APR has passed the R10 completeness check.

Before issuing a BOWP, officers must check the Global Case Management System (GCMS) to ensure that the CIO has reviewed the application and determined that it meets the requirements of a complete application as described in sections R10 and R12.01. If the e-APR is incomplete, the application for a BOWP must be refused. The open work permit holder fee can be refunded, but the processing fees cannot.

Complete application: The CIO will enter the following note in GCMS: “R10 OK.”

Incomplete application: The CIO will cancel the e-APR and enter the following note in GCMS: “E-APR rejected as incomplete. Client not eligible for BOWP.”

Applicants applying for a BOWP must include a copy of their Acknowledgment of receipt - Application for permanent residence letter with their open work permit application.

در نتیجه می توان گفت که درخواست برای مجوز کار باز پوششی را می توان بعد از ارسال مدارک و دریافت «برگۀ تصدیق دریافت مدارک» (اِی.او.آر) انجام داد. برای انجام این کار همان طور که در جمله آخر متن فوق توضیح داده شده است باید یک نسخه از تصویر مدرک زیر را در درخواست مجوز کار باز پوششی خودشان بگنجانند:

Acknowledgment of receipt - Application for permanent residence letter.

به طور خلاصه قدم بعدی این است که مدارک مربوط به درخواست اقامت دایمی از طریق برنامه اکسپرس اینتری ارسال (سابمیت) بشود و بعد از آن درخواست برای گرفتن مجوز کار پوششی داده شود.
